The Paris Convention for the Protection of Industrial Property and the Berne Convention for the Protection of Literary and Artistic Works (the “conventions”) required that certain intellectual property rights of persons from one contracting member state (“home state”) would be protected in the legal system of another contracting member state (“host state”) under the principle of national treatment.
However, because the conventions were not concerned with the level of protection afforded to the relevant rights in the host state, the value of national treatment in the field of intellectual property rights protection is limited.
