Mary has been employed for 5 years as a Teacher. She isn’t permanent or “on a contract of indefinite duration”: Employment Law Assignment, GCD, Ireland
University | Griffith College Dublin (GCD) |
Subject | Employment Law |
Mary has been employed for 5 years as a Teacher. She isn’t permanent or “on a contract of indefinite duration”, she is on a yearly contract that gets renewed annually, after a few weeks of unemployment each summer.
Mary wants the chance to become vice-principal, however, the school she works for says that this position is only open to permanent staff. The school says this is the case as they want to promote those who have been consistently employed by them rather than those “who keep their options open”.
Mary is very upset as she was never offered a permanent contract and always thought of herself as a key member of the school community. Mary is paid as a fixed-term worker by the school itself. The permanent staff is paid by the Department of Education.
Mary wants to bring a case for discrimination and seeks your advice in relation to the above scenario. Advise Mary as to her potential claim for discrimination
under the RELEVANT STATUTE & CASE LAW.
