Joan Murphy is the manager of a disability service. She has just been advised that a resident called Olivia has been assaulted by a member of staff called Martha. Mary was the person in charge at the time of the assault, and she heard shouting from one of the rooms.
When Mary got to the room Olivia, the resident, and a staff Social Worker, Martha, were there. Olivia was crying and rubbing her leg. Mary noticed red marks on Oliva’s head and legs.
Olivia is non-verbal and a wheelchair user. Mary immediately suspected that the injuries were not accidental. Joan received a report from Mary and Joan then reviewed CCTV footage. Joan formed the opinion that Martha had assaulted Olivia by throwing a slipper at her and hitting her on the leg.
Martha disputed this, and she said the video showed that she was following procedure by grabbing, rather than hitting Olivia’s knee and in so doing was performing a trained maneuver to put the resident’s leg back on the footstool of her wheelchair. She also maintained that the slipper hit Olivia’s wheelchair and not her head.
