The gym didn’t state in the contract what the cancellation notice was on the agreement she signed. They wish to charge Deirdre a cancellation fee. This was not stated in the original contract she signed. What are Deirdre’s rights in this scenario?

Scenario 3
Mr. Milligan and his family have booked a holiday with DodgyDealz Travel Service for a 7 Day stay in Marbella in a hotel with a heated swimming pool. When they arrived the hotel did not have a swimming pool. Mr. Milligan’s family applied for a full refund as the terms of the contract weren’t adhered to. DodgyDealz Travel Service offered them a facility at a sister hotel which was 10km away but there would be a charge of 50 euros to access the pool.

Mary Mellows wanted to buy a phone. Upon purchase, she realized her battery wouldn’t stay charged. She returned to the shop to complain. She said that the phone was not of merchantable quality. The phone shop pointed to its notice saying there were “no refunds or exchanges” and said she was simply changing her mind about wanting the goods and that it was part of a sale so she has no rights. What would you advise her?
