University | University College Dublin (UCD) |
Subject | LAW20390: Criminal Liability |
- Cynthia was leaving a nightclub called Tony’s when she spotted Lorraine, who had previously dated Cynthia’s brother and ended the relationship on his birthday. Cynthia pushed Lorraine, who became unsteady on her high shoes, and fell into the path of an oncoming taxi, which hit her.
Stephen, the driver of the taxi, said that he would bring Lorraine to the hospital. A number of people had gathered at this stage and pleaded with Stephen not to move Lorraine and to call an ambulance. However, Stephen did not listen and was assisted by another man in placing Lorraine in the car. Traffic was extremely heavy because it was raining and there had been an accident involving several cars.
It thus took Stephen an hour to drive to the nearest hospital when it would normally take 25 minutes. Lorraine’s condition deteriorated while she was in the back of the taxi. She received excellent medical care on arrival at the hospital but died four hours later. - Gerald, a man with a severe physical disability, lived in the same block of flats as Jeremy. When Gerald’s partner Sarah died, Jeremy began to look after Gerald on a voluntary basis. He did his shopping, cooking, and laundry for two months. Jeremy stopped all contact with Gerald when Gerald joked that Jeremy was only helping him in order to get his hands on his money. Three months later Gerald was found dead in his apartment in terrible conditions.
