1. I began my research by reading Chapter 27 of Michael Forde and David Leonard’s, “Constitutional Law of Ireland” (3rd in, Bloomsbury Professional 2013), which details the Constitutional provisions dealing with the rights of the individual when it comes to education, and relevant case law. I found the same via Bloomsburyprofessionalonline.com, using the following phrase search combined the following Boolean operator: “Constitutional Law” and “education”. This served as a starting point for my exploration of the rights to education afforded by Article 42.3 and Article 42 of the Constitution.

2. The above source cited Chapter 7 of Gerard Hogan and Gerry Whyte, Kelly on The Irish Constitution (5th in, Bloomsbury Professional 2018) as being a relevant resource. As such, I performed a search for the same on Bloomsbury Professional. Said chapter provides a commentary on the personal rights afforded by the Constitution and related case law. Chapter 3 delves into the doctrine of the Separation of Powers.

3. Using the Irish Statute Book website, I found the following pieces of legislation after performing a search for the term “education” and filtering out Statutory Instruments so that only Acts remained:

– Education (Welfare) Act 2000
– Education (Admissions to Schools) Act 2018

4. Using the “View by Section” option, I was able to identify which sections of the legislation were relevant to the issues presented. The legislation helped further clarify my understanding of the appeals procedure; the rights enjoyed by students and their parents; and the duties and powers of school boards, the Minister, and the Appeals Committees in relation to the same.

5. Using the Irish Statute Book, I checked the “Commencement, Amendments, Sis made under the Act” section for each of the abovementioned Acts to ensure that no changes had been made to the texts since their respective enactments. If I was conducting a similar research project in the future, I would conduct the same search via the “Consolidated, Updated Legislation” section of Westlaw. ie. By acquiring the consolidated versions of said Acts, I could be confident that same were up-to-date as of the date of publishing, thereby reducing the margin for error.

6. I visited the “Consolidated, Updated Legislation” section of Westlaw. ie to access the most up-to-date legislation available in relation to this area. I accessed the following acts using the ‘Irish Acts by Year’ functionality:

– Education Act 1998
– Education for Persons with Special Needs Act 2004
– Education (Miscellaneous Provisions) Act 2007
